The election petition tribunal seating in Asaba Delta State capital was on Friday, September 6, 2019 upheld the election of Hon. Chief Thomas Ereyitomi JP, as the rightful occupant of the Warri federal constituency seat in the Federal House of Representatives and dismissed the petition filled by the former reps member Hon. Daniel Reyenieju.

Ereyitomi’s party, the Peoples Democratic Party (PDP), had successfully convinced the tribunal on the incompetence of the petition filed by Reyenieju, of the Social Democratic Party (SDP).

PDP had argued that since SDP had opted out from the start, the petition could no longer be sustained in view of the fact that it was commenced on oath as a joint petition. It noted that the other option for the petitioner would have been to amend the petition but the time within which to do so had elapsed.

However, despite the technical defect of the petition, the tribunal proceeded to examine the matter on the merit of it, and pronounced judgment on merit and dismissed the suit.
