The Court of Appeal sitting in Enugu yesterday threw out the appeal filed by embattled All Progressives Grand Alliance (APGA) gubernatorial aspirant in the last gubernatorial election in Anambra State, Dr. Chike Obidigbo, against Governor Willie Obiano.

The appellate court in a ruling delivered by Justice M.U Abubaji M.J, unanimously dismissed Obigbo’s case with file number CA/E/08/2014 for lack of merit.

Following the nomination of Chief Willie Obiano as APGA flag bearer for the November 2013 gubernatorial elections, Dr. Obidigbo had approached a Federal High Court sitting in Awka with an ex-parte application asking the Independent National Electoral Commission (INEC) to accept him as the APGA candidate for the elections.

The court had ruled in his favour, mandating INEC to accept him along with Chief Obiano as APGA candidates for the election.

But aggrieved by the verdict of the Federal High Court in Awka, Obiano had approached the same court through his lawyer, Barrister Uchenna Enweonwu Esq., and got the court to vacate the same order for lack of jurisdiction.

Consequent upon the ruling of the Federal High Court in Awka, Dr. Obidigbo proceeded to the Court of Appeal Enugu with Appeal number CA/E/08/2014 to challenge the vacation of the earlier order made in his favour by the Federal High Court of Appeal, Awka.

The court, however, dismissed the case, leaving the embattled politician with fewer legal options to explore.

News Express recalls that since losing the APGA party ticket to Obiano in the run up to the November 2013 elections in Anambra State, Dr. Obidigbo and his legal team have been relentless in their probe of legal loopholes that would give him a backdoor entrance into the government house in Awka.
