Lawyer Aloy Ejimakor, lead counsel to the leader of the Indigenous People of Biafra (IPOB), Nnamdi Kanu, has urged the Court of Appeal to set a date soon to consider his client’s bail application.

According to Ejimakor, his call followed the Federal Government’s failure to file a reply brief to Kanu’s brief of argument.

“So, their Brief is overdue. So, it’s unfair to continue waiting for them without considering MNK’s bail application, which is pending before the Court of Appeal,” he told The Guardian.

He added that the next fair thing the Court can do is to promptly consider Kanu for bail.

Ejimakor prayed for accelerated hearing of the Appellant’s/Applicant’s Bail Application filed on June 5, 2026, pending before the Court.

The lawyer pointed out that the Appellant’s/Applicant’s Constitutional right to Liberty and presumption of innocence continue to be violated daily by the non-hearing of his bail application.

He said the Respondent, upon whom the burden lies to justify continued detention, has filed no counter-affidavit, thereby admitting the facts and rendering the application unassailable.

“A single Justice has full vires under Section 10 of the Court of Appeal Act to hear and determine this interlocutory matter.

“Justice delayed in matters of personal liberty is justice denied; the Respondent’s silence cannot be weaponised for indefinite extra-judicial detention,” Ejimakor said.

The Guardian earlier reported that Kanu’s family accused the Department of State Services (DSS) and the Medical and Dental Council of Nigeria (MDCN) of harassing physicians who provided him with independent medical care.

The family also expressed concern over what it described as threats to Kanu’s life, alleged medical neglect and the harassment of his independent medical team, calling for urgent intervention by relevant authorities.

In a statement issued by Prince Emmanuel Kanu on behalf of the Okwu-Kanu Family, the family alleged that Kanu’s health was seriously mismanaged while he was in DSS custody, claiming that his condition only improved after an independent medical team led by Emeritus Professor Dr. Martin Aghaji was granted access to him.

Kanu also claimed that following the intervention of the independent medical team, Kanu’s potassium level improved from 2.1 mmol/L to 2.9 mmol/L, while episodes of nosebleeds, fainting, light-headedness, swollen feet and persistent headaches reduced significantly. (Guardian)
