Action Alliance warns INEC against distortion of facts, misinterpretation of court judgments




The Action Alliance (AA) has cautioned the Independent National Electoral Commission (INEC) against acts capable of misinterpreting court judgments and misleading the public on the valid court judgments delivered on the matter involving the party and the commission.

Specifically, the party warned the INEC National Commissioner in charge of Voter Education, Mr Sam Olumokun, not to distort facts regarding the judgment of the Federal High Court sitting in Osogbo, the Osun State capital, delivered by Justice Funmilola Demi-Ajayi.

Against the backdrop of INEC’s reaction to the recent judgment of the Federal High Court, Osogbo judicial division, the party insisted that INEC failed to comply fully with the court judgment.

The party, In a statement by its National Publicity Secretary, Mr Olu Omotosho, faulted attempts by Olumokun to distort the judgment of the court which he said ordered the Inspector General of Police, Mr Kayode Egbetokun, to effect the arrest of the former INEC chairman, Prof Mahmoud Yakubu, within seven days for the failure of INEC to upload the names of the national chairman of the party, Hon Adekunle Rufai Omoaje, and those of other National Executive Committee (NEC) of the party on its (INEC) portal.

The party observed that INEC complied partially with the judgment as the names of the NEC members elected at the elective national convention of the party held at the Olusegun Obasanjo Presidential Library, Abeokuta, Ogun State, were posted on the commission’s portal without that of the national chairman, Hon Omoaje, as against the court judgment.

Omotosho expressed worry on the action of INEC, saying that the narrative of Olumokun on the judgment was weak and incompetent as partial compliance with court judgment amounts to non-compliance.

“The Action Alliance is of the view that the judgment of the Federal High Court, Osogbo ought to be complied with absolutely regardless of the justification being advanced by Olumokun,” he said.

Also, the party’s National Chairman, Hon Omoaje, said the case before the Supreme Court which Olumokun in his statement referred to has a different background.

He stressed the need for the law enforcement agencies to investigate the actions of Kenneth Udeze, especially the names of those he presented as members of the party in some of the suits before the court to validate the allegation of impersonation he levelled against him.

He Insisted that the party’s National Think Tank committee, which is its highest decision-making organ, had suspended and subsequently expelled Udeze and this, according to him, was upheld by different courts in all the cases instituted by Udeze himself.

Also, he chastised Udeze for turning himself into the spokesperson of INEC following his statement that faulted the order of the court for the arrest of Prof Yakubu.

He wondered why Udeze should be the one to speak for Yakubu in a matter where INEC was fully represented and complied partially with the court judgment.

“In May 2024, precisely the 14th of May, the Supreme Court ruled against an Appeal filed by Kenneth and his men that his expulsion subsists. In spite of this, Kenneth went shopping for any judgement to submit to INEC in what appeared as if he has confidence that whatever judgement he got will give him a respite with INEC. Surprisingly, Kenneth went to get a judgement from the High Court of FCT covertly using a proxy to sue himself. Investigation after the judgement revealed that even the court registry claimed anonymity and criminal proceedings were initiated against him with the Nigeria Police,” he said.

He added that “to date, the Supreme Court had dismissed two appeals filed by Kenneth against his expulsion. The question to INEC by all well-meaning citizens is how an expelled member of a political party or a non-member can become National Chairman of the party. The fact that Kenneth Udeze has ceased to be a member of Action Alliance is not in contest at all, moreso that INEC under Prof Yakubu monitored both suspension and his expulsion proceedings and even has it in its record.” (Sunday Sun)
