Osun LG: Only Supreme Court can reverse Feb 10 judgment, APC tells Adeleke, PDP

Against the backdrop of a raging crisis over the control of local government councils in Osun, the state chapter of the All Progressives Congress (APC), on Monday, told the ruling party, the Peoples Democratic Party (PDP) and Governor Ademola Adeleke, not to misinterpret the recent Court of Appeal judgment delivered in Akure.

It cautioned that only the Supreme Court has the authority to invalidate the February 10, 2025, judgment of the Court of Appeal, which reinstated APC-elected local government chairmen and councillors who a Federal High Court ruling had hitherto sacked in November 2022.

A statement by the APC legal adviser in Osun, Adegoke Ogunsola, accused Adeleke and the PDP of jubilating over the June 13, 2025, Court of Appeal judgment in bad faith.

“The PDP and Governor Adeleke are twisting the facts. The Court of Appeal’s decision on June 13 did not overturn its earlier judgment of February 10. Only the Supreme Court can do that,” he argued.

While maintaining that the June 13 decision only refused to relist an appeal dismissed on procedural grounds on January 13, 2025, Ogunsola maintained that the appeal involved the same facts and issues already conclusively decided in Appeal No. CA/AK/270/2022.

According to him, the Court of Appeal’s February 10 ruling had allowed the APC’s appeal against the Federal High Court judgment to set aside the lower court’s rulings delivered on September 15 and November 25, 2022.

Ogunsola submitted that “the court also dismissed suit No: FHC/OS/CS/94/2022 filed by the PDP and reinstated the APC-elected chairmen and councillors from the October 15, 2022, local government elections.

“These decisions remain binding and unchallenged by any higher court,” Ogunsola posited, stressing that “the PDP’s attempt to mislead the public and security agencies is a calculated effort to undermine judicial authority.”

He chided the Adeleke administration for citing a “purported” PDP-conducted council election held on February 22, 2025, which he insisted had no legal standing and was not part of the issues before the court.

“No party sought a court pronouncement on the alleged PDP election during the motion to relist the dismissed appeal,” Ogunsola was quoted as stating. (The Guardian)
