Kebbi State Election Tribunal sitting in Birnin Kebbi, on Thursday, April 27, 2023, adjourned further hearing of Senator Bala Ibn Na’Allah’s petition filed before the Tribunal, against Garba Musa, Peoples Democratic Party (PDP) and Independent Electoral Commission (INEC), challenging the outcome of the recently concluded Senatorial election of Kebbi South Senatorial District.
In the court session, counsel to petitioner Barrister Habib Muhammad Bello, told the court that the matter was selected today (Thursday) for pre hearing of the petition but lamented that the petitioners where not served with pre hearing question.
“There was no sufficient service, that is why we humbly moved an application for adjournment to enable all parties in the matter to be served,” he said.
In their own separate responses, counsel to first defendant Barrister Mustapha I. Abubakar, Second defendant counsel Barrister Williams Ataghoba and counsel to the third defendant Barrister Hussaini Zakariya SAN, all conceived to the application moved by the petitioners counsel seeking for adjournment.
Honourable Justice Margret Opara Chairman of the State Tribunal and her colleagues after hearing from all the parties, adjourned the matter to 2ndMay for continuation of hearing.
The Tribunal however, reminded all parties that the election petition is sui-generis in nature and be mindful of time.
“We are here for you and to hear and determine all the petitions before us within the time frame prescribed by law, so why long adjournment,” Chairman of the Tribunal told all the parties.
