Tribunal rejects application seeking recount of ballot papers in Ogun election

Justice Elvis Ngene-led three-man National Assembly Election Petition Tribunals sitting in Abeokuta, the Ogun State capital has rejected an application seeking to recount the ballot papers used in the Ijebu Ode/Odogbolu/Ijebu North East federal constituency in Ogun State.

Justice Ngene, while reading the ruling on an ex parte motion brought before it by the petitioners; Taiwo Shote and Peoples Democratic Party, PDP, said the prayer was not captured by section 151 of the Electoral Act.

According to him, the Electoral Act was clear on the ex parte order which the tribunal can be granted which, he said, does not go beyond inspection of electoral materials of Certified True Copies of the materials.

He further explained that the Tribunal was bound by the decision of the Court of Appeal on the matter, which, according to him, has not been tested at the Supreme Court level.

Counsel to the petitioner, Esom Ifeoma has prayed the court to order the recount of ballot papers used in the election, amongst other prayers contained in the motion.
