
The Kebbi State High Court, Birnin-Kebbi
The Kebbi State High Court sitting in Birnin-Kebbi, presided over by Justice Sabiu B. Shuaibu has restrained one Sofiyanu Bala, Junaidu Muhammad Modi, and Hauwau Muhammad from parading themselves as the leaders of the African Democratic Congress (ADC) in the state.
Justice Shuaibu, while granting the interim injunction in the suit number, KB/HC/M.482/2025, filed by the Applicant, Abdulrasak Abubakar, ordered that the 1st, 2nd and 3rd defendants should stopped parading themselves as the Chairman, Deputy Chairman and Secretary of ADC in Kebbi, and that they must stopped running the affairs of the party pending the determination of the matter before the Court.
In the Judgment after the hearing on the motion ex-parte dated 16th day of September, 2025, with the submissions made by G. A. Shehu, counsel for the Applicant, Abdulrasak Abubakar against 1st,2nd and 3rd respondents, Justice Shuaibu halted their intentions and plan to hold or summon meetings and relocate the ADC Secretariat to another place.
According to the copy of the judgment obtained in Birnin Kebbi by our reporter, dated 31/10/2025, the respondents were restraint by the virtue of the provisions of order 39 Rules 3 (3) of the Kebbi State High Court (Civil Procedure) Rules, 2017, abate after 7 days.
In his ruling, Justice Shuaibu ordered an interim injunction restraining the 1st, 2nd and 3rd defendants/ respondents by themselves, their agents, privies, assigns or through any other person whose conduct may give effect to the intentions of the defendants/respondents from parading themselves as chairman, Deputy Chairman and Secretary of the Kebbi State Executive Committee of African Democratic Congress respectively pending the hearing and determination of the Motion Notice in Motion NO:KB/HC/M.481/2025 before this court.
“Order that the 1st, 2nd and 3rd defendants/ respondents by themselves, their agents, privies, assigns or through any other parson whose conduct may give effect to the intentions of the defendants/respondents from running or attempting to run the affairs of the party pending the hearing and determination of the Motion Notice in Motion NO: KB/HC/M.481/2025 before this court.
“An order of interim injunction restraining 1st, 2nd and 3rd defendants/ respondents by themselves, their agents, privies, assigns or through any other person whose conduct may give effect to the intentions of the defendants/respondents from summoning and holding any meeting for the purpose of running the affairs of African Democratic Congress pending the hearing and determination of the motion notice in motion NO:KB/HC/M.481/2025 before this court.
“An order of interim injunction restraining 1,2nd and 3rd defendants/ respondents by themselves, their agents, privies, assigns or through any other parson whose conduct may give effect to the intentions of the defendants/respondents from relocating or attempting to relocate the secretariat of the African Democratic Congress Kebbi State Chapter from its present location opposite Kara Market Sani Abacha Way Birnin Kebbi pending the hearing and determination of the Motion Notice in Motion No: KB/HC/M.481/2025 before this court. The above orders shall, by virtue of the provisions of order 39 Rules 3 (3) of the Kebbi State High Court (Civil Procedure) Rules, 2017, abate after 7 days”.
While reacting to the ruling after an emergency meeting with members of the party in Birnin Kebbi, the Applicant, Abdulrasak Abubakar, noted that base of the Court order, there is only one ADC party in the state and one Secretariat.
According to him, “we don’t have any other branches, or any other Secretariat in Birnin Kebbi except this one which I am the Chairman. At this juncture, I want to call of the general public to know that ADC is one in Kebbi state under my leadership. They should not do anything with anyone parading themselves as the leaders of the party.
“Those who are claiming to be leaders of the party in the state should stop henceforth or they would have to blame themselves on the consequences that follows their disobedience”, he warned. (The Sun)
