Deposed Oluloro of Iloro, Oluwafemi Olugbesoye
An Ekiti High Court presided over by Justice J. B. K Aladejana has deposed Prince Oluwafemi Olugbesoye as the Oluloro of Iloro, Ijero LGA of Ekiti State.
This follow a suit numbered HAD/61/2022, filed by Prince Fadare Festus Olakunle and four others on April 14, 2022.
The claimants by a wit of summons along with a statement of claim; at paragraph 31, therefore claimed against the defendants, amongst others as follows:
1.A declaration that the failure and refusal of Prince Olugbesoyo to present himself for coronation rites by the Aoropare in line with the native law and customs of Oluloro of Iloro Ekiti chieftaincy is wrongful
2.An order of the court directing the 2ndto 5thdefendants to depose the 1stdefendants as Oluloro of Iloro Ekiti in line with the customary law of Iloro Ekiti
3.An order of perpetual injunction restraining the 2nddefendant from parading himself as Oluloro of Iloro Ekiti, Ekiti state.
The 1st defendant, Prince Olugbesoye, on the 6thof October 2023, in his defence amongst others, filed an amended statement at paragraph 13 urging the court to ?dismiss the claimant?s claim in its entirety with substantial cost for being frivolous, speculative, gold digging and vexatious.
In his judgement rendered on Monday, September 30, 2024, Justice Aladejana declared as follows:
In the circumstances, the sole issue formulated is resolved in favour of the claimants and against the defendants.
This action of the claimants succeeds.
I consequently declare that
1.The failure and refusal of the 1stdefendant to present himself for coronation rites by the Aoropare in line with the native law and customs of Iloro Ekiti is wrongful
2.I also order the 2ndto 5thdefendants to depose the 1stdefendant as the Oluloro of Iloro Ekiti in line with the customary law of Iloro Ekiti
3.I make an order of injunction restraining the 1stdefendant from parading himself as the Oluloro of Iloro Ekiti.
Finally, I make an order of injunction restraining the 2ndto 5thdefendants from dealing with or recognising the 1stdefendant as the Oluloro of Iloro Ekiti.
There shall be no order as to cost, Justice Aladejana added.
