Senator Jimoh Ibrahim
The federal high court, Abuja, presided over by Hon Justice Inyang Ekwo has dismissed the case filed by Senator Jimoh Ibrahim against the APC governorship primary election held in Ondo State on April 20, 2024.
When the matter came up today, May 29, 2024, Mr Olakunle Lawal appeared for the plaintiff while Matthew Burka, SAN appeared for APC. Bode Olanipekun, SAN appeared with Ebun-Olu Adegboruwa, SAN for Governor Lucky Aiyedatiwa. Charles Edosomwan, SAN appeared with Suleiman Ibrahim, SAN for INEC.
Olakunle Lawal informed the court that the plaintiff has a notice of withdrawal dated May 27 but filed on May 29, 2024. Matthew Burka, SAN informed the court that he has been served with the notice of withdrawal and he has no objection. Bode Olanipekun, SAN informed the court that he has also been served with the notice of withdrawal and he has no objection. Charles Edosomwan, SAN informed the court that he has been served with the notice of withdrawal. Althorough he has no objection it is important for the plaintiff to work with the Governor as members of the same political family.
After listening to all counsel for the parties, the court held that the proper order to make in the circumstances was to dismiss the case of the plaintiff since the defendants have joined issues with him. The case was accordingly dismissed.
