I quite appreciate the approach to discipline erring judges. We red on the pages of Newspapers that judges from Imo State were compulsory retired on a petition from a civic society organisation on the issue of falsification of their ages. I understand that a civic society organisation can not write directly to NJC and NJC relied on it to begin investigating those judges. The constitution provides that the state Judicial service Commission does the investigation and forward to NJC for further investigation and action. Again, information had it that as at the time, the CSO did not have a know address. The issue of age falsification is seen to be perjury and unless a court so pronounces it cannot be relied on. The NJC converted itself to a court, took the decision and recommended the judges involved for compulsory retirement. Noe, sometimes when the NJC disciplines a judge by recommending to the governor of the state the the judge be compulsory retired, a time frame must be given for, say three months highest, for the governor to implement the recommendation or acquit the judge. In the cause of any delay by the governor to implement the NJCs recommendations, the judge should not be allowed to suffer through the negligence of the governor. The NJC has to look into these areas. Lastly, to avoid the issue of falsification of age, which requires a court of competent jurisdiction to make pronouncement on, the NJC should ensure that no judge for appointment presents an affidavit for age declaration, but add in their guidelines that such judges must supply the age information with the Nigerian Law School.
