The people of Umuawo, Nando in Anambra East Local Government Area of Anambra State, have accused a neighboring community, Abube Agu, of trespassing into their land and forcefully taking some part as well as some houses of members of the community.

A petition dated 9^th March, 2017 which was made available to Journalists in Awka by Counsel to Umuawo Community, I.C Nsofor, alerted the Court of Appeal of what it described the attitude of the state boundary committee as utter contempt of the court saying that they are not oblivious of the consequences.

According to them, they have petitioned the state Governor, Chief Willie Obiano, and the Department of State Service (DSS) over the land dispute with Abube-Agu Community in the area.

The petition was also copied to the Registrar, Court of Appeal, Enugu, Chairman, State Boundary Committee in the state and the member representing Anambra East and West Federal Constituency, Hon. Tony Nwoye.

The community members, however, claimed that the petition they wrote has already propelled the state government to set up a peace committee to access the situation and come up with ideas on how it could be resolved.

The petition reads: “It is surprising that the said Committee, being influenced by members of the Abube-Agu community who accidentally found themselves within the corridors of power in Anambra State, have revisited the issue of boundary demarcation and is planning to visit the land and re-demarcate same to suit the whims and caprices of these individuals.

“Recall that the Court of Appeal is now fully seized of the matter and your conduct amounts to sitting on appeal over the Court of Appeal proceedings and same is an affront to the said court.

“Bear in mind that should you go ahead and re-demarcate the land which is already subjudice, it will foist on the Court of Appeal a fait accompli.

“Take notice that our clients will not participate in the purported re-demarcation of the boundaries of the land in question should you insist on going on with the re-demarcation until the Court of Appeal finally determines the appeal.

“Also take notice that the Committee should be answerable for any attendant break down of the law and order in the parties' community should the Committee go on with the boundary re-demarcation.

“Take further notice that we shall endorse a copy of this letter to the Registrar, Court of Appeal, Enugu to alert their Lordships of the utter contempt of the court being perpetrated by your Committee of which you very well know the consequences.

“We shall cause the relevant Form 48 to be served on you and members of the Committee should you defy the Court of Appeal and continue with the on-going illegality.”
